European Union (Investment Firms) (Amendment) Regulations 2025 published in Iris Oifigiúil
On 6 February 2025, the European Union (Investment Firms) (Amendment) Regulations 2025 (the Regulations) were signed into law and published in Iris Oifigiúil on 7 February 2025. The Regulations give further effect to the Investment Firm Directive (Directive (EU) 2019/2034) and make amendments to the European Union (Investment Firms) Regulations 2021 and the European Union (Capital Requirements) Regulations 2014.
European Commission proposes extending ESMA procedural rules to CTPs
On 6 February 2025, the European Commission published a draft delegated regulation with the aim of amending Commission Delegated Regulation (EU) 2022/803 to extend the European Securities and Markets Authority’s (ESMA) procedural rules to include consolidated tape providers (CTPs). The proposal aims to widen the Commission Delegated Regulation’s scope to include all data reporting service providers (DRSPs) overseen by ESMA and to ensure consistent application of ESMA’s procedural rules for fining powers across all supervised DRSPs, aligning with the upcoming CTP authorisation process. The procedural rules govern rights of defence, collection of fines or periodic penalty payments, and limitation periods for imposing and enforcing fines and periodic penalties. Feedback received from 6 February to 6 March 2025 will be considered in the finalisation of the initiative.
