ALG secures successful outcome for hundreds of Irish farmers
Our Belfast office was pleased to secure a successful outcome for hundreds of pig farmers across the island of Ireland in a recent High Court ruling.
Ongoing since 2015, the case – North South Pig Company (NI) Limited vs. Truly Irish Country Foods Limited (and various former Company Directors) – was complex in law and fact, concerning alleged breaches of shareholders' agreements and directors’ duties.
In his judgement, released on Friday 19 February 2021, Mr Justice Huddleston found the four former directors had acted in breach of their fiduciary duties on a number of counts. This included the payment of dividends and formation of a competing entity, Truly Irish Country Foods, whilst directors in North South Pig Company (NI) Limited.
Commenting on the judgement, Partner Barbara Creed said: “We are delighted with this successful outcome for our client in what has been a complex case.
“The case reaffirms the need for directors to be acutely aware of their duties, and the personal consequences of breaching those duties."
