Competition (Amendment) Act 2022
Be prepared and up to speed on the significant and wide-ranging new powers of investigation, intervention and enforcement being given to the Irish Competition and Consumer Protection Commission (CCPC), under the Competition (Amendment) Act 2022. The main changes will:
- for the first time, allow the CCPC to directly impose administrative / civil fines for breaches of competition law
- provide a leniency programme for breaches of competition law
- provide additional powers of surveillance to the CCPC to investigate certain criminal offences
- change the merger control rules, including by granting the CCPC a "call in" power for certain "below threshold" deals to be notified.
